Video shows Lyft driver kicking woman out of car for racist comment – ​​NBC10 Philadelphia

A Lehigh County bar owner and her boyfriend will not face charges after a video of a rideshare driver refusing them a ride over racist comments went viral earlier this month .

On Monday, Lehigh County District Attorney Jim Martin said, “No criminal charges would apply to the conduct – however reprehensible it may be.”

“After investigation and consultation with the district attorney’s office, no charges should be filed,” Catasauqua Police Chief Douglas F. Kish said in a statement.

James Bode, the Lyft driver, posted the viral video from inside his car on his Facebook page. The video has generated millions of views on Facebook, Twitter, YouTube, Reddit and beyond.

The moments filmed occurred on the night of May 13 outside Catasauqua Fossil’s Last Stand bar in Lehigh County.

The borough police department has confirmed that the woman seen entering the Lyft is Jackie Harford, owner of Fossil’s.

The video, just over a minute long, begins when Harford gets into Bode’s car. He asks if the ride is for “Jackie” and she confirms it.

“You’re like a white guy,” Harford said as he got into the car from the rear passenger side. Bode asks, “What is it?”

“Are you, like, a white man?” asks Harford, who then heads for the center of the car. “Are you like, a normal guy?” Harford said. “You speak English?”

There’s a short pause before Harford laughs, pats Bode on the shoulder, and apologizes. Bode then tells him to get out of the car, saying what Harford said was inappropriate.

“If someone wasn’t white, sitting in that seat, what would be the difference?” Bode asked.

The rear passenger door of the car is still open and Bode repeats to a man, who police believe is Harford’s boyfriend, standing outside the car that he will not be making the trip.

“Really?” the man said, “You’re a f—–g a–hole.”

Bode points to the camera inside the car and tells the boyfriend that it’s all on video.

“I’m going to punch you in the fucking face,” the man said to Bode.

Bode calls the pair “racist lunatics,” as Harford gets out of the car.

That’s when the man calls him a “[n-word] lover.”

Bode rolls down the window and tells the couple he’s calling the police.

Catasauqua Police Chief Douglas Tish confirmed Bode filed a police report at 10:27 p.m. that same night.

Lyft replied to a version of Bode’s video has over 3.3 million views on Twitter.

“We are extremely grateful to the Lyft driver @Jameswb333 for instantly ending this hate and maintaining our no-tolerance anti-discrimination policies,” Lyft said. “We are reviewing these riders and are in touch with James to express our thanks.”

The Fossil’s Last Stand website and Facebook page have been deactivated.

Yelp and TripAdvisor have closed reviews for the bar’s two pages after being inundated with negative reviews and one-star ratings.

Efforts to reach Bode have been unsuccessful, however, in a post last week, Bode expressed his gratitude for the support he has seen.

“But that’s how it should be everywhere, every time,” Bode wrote. “I shouldn’t be ‘the guy’ who did it or said it… we should all be that person. Speak up if you’re not comfortable with it because it hurts them.” comfortable, as they should be. F**k racism,” Bode wrote.
